Passenger Sues JetBlue After Allegedly Being Served “Frozen Solid” Ice Cream

A passenger is suing JetBlue in federal court after she was served an ice cream sandwich that was “dangerously cold. ” According to the passenger, the airline’s flight attendants should’ve warned her that the item was unfit for immediate consumption.

The incident happened on August 20th, onboard JetBlue flight 1907 from New York John F. Kennedy International Airport (JFK) to Paris. A passenger was served an ice cream sandwich that resulted in disaster and a broken tooth. She has now initiated a lawsuit against the airline, hoping to find it negligent.

According to The Independent, the plaintiff in the lawsuit is New Jersey native Karla Quinonez, who alleges that JetBlue was negligent for “serving food at a temperature below what is reasonable or safe for consumption.” In addition, the lawsuit claims that the airline worsened the issue by “failing to warn her of the dangerously cold temperature and the solid state of the ice cream sandwich she was served. ”


The issue lies in what happened after Quinonez was served the ‘chomp’ size strawberry shortcake-flavored ice cream sandwich manufactured by the Nightingale Ice Cream Company. Upon trying to consume it, she broke her upper left lateral incisor, which has allegedly caused a lot of mental and physical anguish.

The tooth required an emergency extraction that had to be performed as soon as she landed. She also needed an implant to replace her tooth. The plaintiff alleges that she needed further medical care once she returned to the US.

Quinonez claims she is not responsible for her injuries and demands a money judgment against JetBlue. The jury will decide whether she will be successful. If she wins, she will receive a payout plus legal costs.

Multiple lawsuits

Airlines have an obligation to care for their passengers and keep them safe during the flight. Quinonez alleges that the airline breached its duty of care by allowing her to crack her tooth on the hard ice cream sandwich.

Many passengers sue airlines for all manner of damages and alleged slights. In June, a passenger sued JetBlue after a cup of hot tea spilled on her chest, arms, and buttocks during turbulence. Another passenger sued the airline in the last few months after she fractured her ankle after it was entangled in a hanging seatbelt.

Some people do sue for unbelievable reasons, such as the suit brought against the airline in July, where a California native claimed that her cancer returned after she was thrown off a flight. The passenger argued with a crewmember over the emotional support animal.


JetBlue isn’t the only airline dealing with lawsuits from passengers. American Airlines was recently sued after a woman allegedly suffered severe first and second-degree burns over her body after a cup of coffee spilled on her. Korean Air also faced numerous lawsuits and stopped serving instant cup noodles after an increase in burn-related injuries.

In many of these suits, if the plaintiff can prove the airline’s negligence, the settlements can be in excess of $100,000. It is unclear if Quinonez has a bulletproof case, as the damage could have been avoided if she had been more attentive. But the final decision is up to the jury.
